Complaint made regarding public disturbances and public nuisance caused by Sanmugunathan Navaradnarajah and Navaradnarajah Ajantha

Kuppusamy Wijayan’s complaint was about the activities of some villagers who prevented the burial of the body as it was not a cemetery reserved for non-Roman Catholics

The issuance of an absolute order at once in urgent cases of nuisance was sought by the OIC based on complaints by the residents of the area.

The complainant parties’ church was pelted with stones for over a month. The stone pelting was allegedly due to suspicions of illegal activity by close members of the pastor.

Issue before the MC- The residents of the area had complained to the police that a large number of people were congregating at the respondent-petitioner’s residence.

The application was filed by the petitioner on behalf of his daughter (who is a minor) seeking a writ of Mandamus.

The petitioner (Christian) complained mentioning that his fundamental right to equality guaranteed by Article 12 of the Sri Lankan Constitution has been infringed by the Principle of Kingswood College.

Petitioner alleged that his fundamental right to equality was violated when Kingswood College, Kandy denied his son admission to Grade 1 of the school for 2017.

The Petitioner complained that her fundamental right to equality guaranteed has been infringed by the Principal, Girls’ High School Kandy by refusing admission of her daughter to Grade 01 of the school.
