Facts of the case

All the accused mentioned in the case gathered at a mosque in Addalaichenai with the intention of committing a criminal act and stole seven items from the mosque. All were charged with three offences; 

 

1. unlawful assembly under section 146 of Penal code of Sri Lanka has to be read with section 140. 

 

1. dishonestly misappropriated or converted to their own use that movable property under section 146 of Penal code of Sri Lanka has to be read with section 386.

 

1. dishonestly misappropriated or converted to his own use that movable property under section 386 of Penal code of Sri Lanka has to be read with section 32.

FoRB related issue – Violence: non-physical

Holding/Decision

Court compounded without compensation. The accused were discharged on 1st charge and compounded and acquitted.
